Golf EQ Privacy Policy

EQ Software, LLC (“Golf EQ”) works hard to provide a positive experience for all golfers and others (collectively known as “users”) who visit Golf EQ and is committed to protecting the privacy of our users. This Privacy Policy applies to Golf EQ and its Golf EQ website, including any and all entities that control, or are controlled by, or are affiliated or under common control with, Golf EQ (collectively referred to throughout this Privacy Policy as “we,” “us” or “our”). Although this Privacy Policy applies to all information that we collect through Golf EQ, not everything in this Privacy Policy will necessarily apply to every product or service offered on Golf EQ. Please note that Golf EQ may contain links to other third-party websites that are not controlled or operated by Golf EQ. What types of information do we collect?

We collect several kinds of information to allow us to provide you with products or services in which you may be interested, but we never sell information about you to third parties.

Information Provided to Us by Guests

We collect several kinds of information to allow us to provide you with products or services in which you may be interested, but we never sell or disclose information about you to third parties. In order to ensure that users are provided with accurate information about their accounts, and content geared to the interest of that user, we may ask for personal information when a user registers for, logs on to, or visits Golf EQ. The personal information that Golf EQ may collect may include your name, username, password, email address, address, telephone number, and any other personal information that you choose to include in your profile, or in other communications to Golf EQ. You represent and warrant that you have the right and authority or have obtained all necessary consents to provide any information, including any personal information of another individual, that is provided by you to Golf EQ. For the purposes of creating an account on Golf EQ users provide an email address and can provide additional information at their discretion. User accounts on Golf EQ do not require the use of any personally identifiable information, and an email address for a user is also not required although we require users to have a unique username and password which often is easiest to maintain using a unique email address. When we use or associate other information with information that could be used to identify or contact a Golf EQ user specifically, this other information is considered personal information for purposes of this Privacy Policy.

Golf EQ is an Internet delivered service. As such, Golf EQ may also collect information that may not be personal information, which may include, but is not limited to, the frequency of user visits to the site, the routes by which users access the site and services and use of any hyperlinks available on the sites. Golf EQ or its service providers and agents may process and use this aggregate data for various purposes including, but not limited to, analysis of this data for trends and statistics, development of the site and services and the site and service features and offerings, assessing patterns of use, planning and evaluating updates or improvements. This information is gathered by certain tools and methods such as the collection of your IP address or the use of cookies and is maintained, used and disclosed in aggregate form unless otherwise noted. While using some of our products or services, users may have the opportunity to provide photographs, videos or other materials that may contain information that would enable identification of the user. Bearing this in mind, all users should review any material sent to ensure that it is appropriate for sharing. Similarly, some of our Golf EQ services may offer online social, community or other communication features that allow users to post, or share with others, messages, stories, pictures, artwork, videos, testimonials, lesson plans, or other content. Along with such content, users also may be given the opportunity to post certain personal information about themselves and other miscellaneous information related to the content. Please note that although we may take various steps to protect our users, we cannot guarantee that content posted by a user will not be seen by someone other than the audience intended by the user. By choosing to post items or use any of our social or communication features users acknowledge that they do so at their own risk and will only share information and images which they have a legal right to share. If we choose to make online social or other communication features or similar services available to children, we will be sure to abide by the applicable United States laws including the Children’s Online Privacy Protection Act. Information Collected Using Technology

Golf EQ may automatically collect information concerning a user’s computer hardware and software, including for example, the computer’s Internet Protocol (IP) address, computer operating system and web browser type, or the type of Online Service being used (including the product ID or serial number and product license information). Golf EQ may also collect information that may not be personal information, which may include, but is not limited to, the frequency of user visits to the site, the routes by which users access the site and services and use of any hyperlinks available on the sites.

Golf EQ utilizes “cookies” to maintain a record of your visit to the site and your use of the services. A cookie is a small text file that is transferred by a web server and stored on the hard drive of your computer or mobile device. It can only be read by the server that sent it to you. This information does not identify you personally and you remain anonymous unless you have otherwise provided Golf EQ with personal information. Most web browsers automatically accept cookies. IP Addresses

An IP address is a computer's numeric address, by which it can be located within a network. Golf EQ may record your IP address when you visit or use services or features on the Golf EQ site. Golf EQ may use your IP address for the purposes noted above, and to help diagnose problems with Golf EQ’s server, or to administer the Golf EQ site. Golf EQ may also use your IP address to identify you when Golf EQ feels it is necessary to enforce compliance with this Privacy Policy or the Terms of Use, or to protect the Sites, systems, information, employees, service providers, business partners, users, customers and others.

Third Party Analytics and Tracking

Golf EQ uses automated devices and applications provided by third parties, such as Google Analytics, to evaluate usage of Golf EQ. We also may use other analytic means to evaluate our site. We use these tools to help us improve our site, performance, and user experiences. These entities may use cookies and other tracking technologies which collect information to perform their services.

Protection of Your Information

To prevent unauthorized access or disclosure, maintain data accuracy and facilitate the appropriate use of information, Golf EQ uses physical, technological and administrative procedures to protect the personal information that Golf EQ collects from loss, unauthorized access, modification, disclosure or other misuse. Internet or wireless transmissions are never completely private or secure. You understand that any messages or information you send to the sites may be read or intercepted by others. Choice and Opt-Out Preferences

Golf EQ does not collect your personal information except in accordance with this Privacy Policy. If, at any time, you prefer not to receive further email communications from Golf EQ (except in connection with information, products or services that you specifically request), you will have the ability to unsubscribe from such communications by means of a link provided in the footer of every broadcast e-mail that is sent to you by Golf EQ. If, at any time, you prefer not to receive any other form of communication from Golf EQ, you can also unsubscribe by signing into your Golf EQ account at www.golf-eq.com and managing your email preferences in your profile. When and how much personal information do we collect?

The timing and amount of information that we collect from users will depend on how much the user interacts with Golf EQ. Please be assured that we try to collect only the information needed to provide users with the quality products and services they have come to expect from Golf EQ.

We may request a user’s personal information when they:

Log on to Golf EQ;

Place an order on one of our eCommerce enabled websites for products or services;

Send us an email or otherwise contact us using the online tools that we have provided on any of our websites, including for example “Contact Us,” “Customer Support,” or “Live Chat” features;

Do we share personal information with other parties?

Golf EQ is committed to preserving privacy and does not sell information about its customers or Golf EQ users to other companies. We do not share any information that would individually identify our users or individual customers to third parties, except for such sharing as you may consent to time to time. For the avoidance of doubt, such consent shall include implied consent, such as creating an account for the purpose of shopping with one of our retail partners. Additionally, we reserve the right to disclose the personal information of our users, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) comply with the law; (b) protect and defend the rights or property of Golf EQ and, (c) protect the personal safety of users of Golf EQ, or the public.
